In North Carolina, there are only a few ways to make one side pay for the other party’s attorney’s fees in family law cases. First, if the parties reach an agreement, either in a Separation Agreement or by Consent Order, they could agree on how attorney’s fees will be allocated. Or, attorney’s fees might be provided by statute to the victorious party depending on the nature of the case.
Some people might think that the party who makes more money has to pay the other party’s legal fees. This case says “not so fast.”
